I recognize that as a
Breeder / Exhibitor I am responsible for the future of the Chinese Shar-Pei. As
such I agree to uphold the highest standards of personal and professional
conduct and engage in breeding only for the betterment of the breed. I
furthermore agree that I will take care in all my breedings to assure the
protection and advancement of this breed according to the Standard.
To accomplish this goal I agree to:
1. Not breed any bitch prior to the age of eighteen (18) months or after the
age of eight years. In addition I will have the bitch hip X-rayed and be assured
she is screened for known and recognizable inherited diseases and disorders.
2. Have any of my breeding stock OFA or Penn hip preliminary certified at a
minimum.
3. Use only studs who have reached the minimum age of one year (1), have been
suitably hip X-rayed and have been appropriately screened for known and
recognizable inherited diseases and disorders.
4. Never sell or give any puppy or dog to pet stores either on consignment or
outright.
5. Never place a puppy out of my home until it has reached the age of no less
than 8 weeks from the date of birth.
6. Never offer any of my dogs or dogs I am responsible for, to any form of
auction sale or raffle.
7. Sell or place any dog with a written contract that shall require the
following clauses:
A. All pet or companion quality dogs will be sold or given on a
spay/neuter agreement.
B. Contracts shall contain a right of first refusal so if the owner can
no longer keep the dog I will either take it back or assist in finding it a
suitable home.
C. Contracts shall contain a health guarantee, which will cover the dog
for a minimum of thirty (30) days.
8. Understand that if I am suspended from the AKC for any violation of their
rules I will be automatically suspended from the CSPCA for a similar time
period.
9. Understand that the CSPCA has the right to temporarily suspend my
membership in the organization pending final outcome of any criminal, civil or
AKC trial or hearing.
10. Commit that all my advertisement of puppies, and adult dogs, written or
oral shall be factual and honest in both substance and implication.
11. Declare that, if any of my breeding stock dies for any reason prior to the
age of nine (9) years old, I am strongly committed to have a Congo red stain
performed to check for the presence of Amyloidosis. I will further provide the
results of these tests upon request from any member who has a legitimate
interest in the lines of the dog, which can be but not limited to:
A. Having get from the bitch or owning or having owned a bitch bred to
the dog.
B. Having get from the first or second generation of that dog or
bitch.
C. Be directly involved in the gathering of evidence on Amylodosis of
FSF, SHS or related disorders for any research being conducted or sponsored by
the CSPCA or CSPCA Charitable Trust.
12. I will not knowingly sell to breeders, or to persons whose intention to
resale is known or suspected.
13. Keep my dogs in clean; sanitary and safe conditions with the utmost care
being given to their health and well-being.
14. Give regular and necessary inoculations and keep accurate records of it.
15. Keep accurate records of all dog registrations, matings, litters, and buyers
of their puppies as required by the AKC.
16. Follow all AKC record keeping procedures.
EXCEPTIONS
It is recognized that legitimate exceptions to this Breeder’s Code of Conduct
may arise from time to time. In such cases, any member may request that the
problem be reviewed by the Chairman of the CSPCA Ethics Committee, or the
Chairman’s designee, who will make a recommendation to the CSPCA Board of
Directors. Furthermore, in certain cases, with sufficient evidence, and under
conditions where the welfare of the breed is assured, the Board of Directors,
may waive any of the foregoing provisions.
ENFORCEMENT
Enforcement of this Code will be the ultimate responsibility of the CSPCA Board
of Directors. All members shall utilize the following guide when filing a
complaint or asking for an exception to a clause(s) in this Code.
1. Complaints shall be in writing and signed by the complainant(s).
2. Complaints shall clearly outline the charge(s) and substantiating evidence
to support the charge(s).
3. Complaints shall be sent to the Chairman of the CSPCA Ethics Committee along
with a $ 100 filing fee for copies and distribution. If, after investigation
and adjudication of the issue the complaint is found to be "Sustained" or
Partially Sustained", $75.00 of the filing fee shall be returned to the
complainant. If the complaint is not sustained, the
CSPCA shall keep the $100 filing fee in total. The Chairman and the
committee of the CSPCA Ethics Committee shall conduct the initial inquiry.
4. The Chairman and committee shall review the complaint for substance and, if
the contents comply with the requirements of part 1 & 2 of this Section, it may
be deemed sufficient to proceed with a hearing.
5. The person or persons named in the complaint shall be notified of the
charges by registered mail, within thirty (30) days of receipt of the complaint.
6. The Chairman or his/her designee shall notify the interested parties and come
to a mutually agreeable date for a hearing. Unless extraordinary circumstances
prevail a hearing shall be held no later than sixty (60) days after receiving
the original complaint.
7. A hearing may be held either with the parties in person or by teleconference
call. The entire cost of the hearing shall be the responsibility of the one
making the charges.
8. The CSPCA Ethics Committee Chairman shall preside over the hearing and shall
allow reasonable time for both sides to present their cases and to ask relevant
questions concerning these charges.
9. After the hearing, the Chairman and committee members of the CSPCA Ethics
Committee shall review the testimony and evidence and issue a ruling that will
consist of one of the following:
A. Sustained. There is probable cause to believe that the accused
committed or caused to be committed the acts or omissions charged.
B. Partially Sustained. Probable cause was found to determine that a
certain portion(s) of the allegations were found to be Sustained.
C. Not Sustained. The evidence does not support the charges.
D. Unfounded. Evidence does not support any fact that the accused
person(s) did to violate the Code of Conduct.
10. The CSPCA Board of Directors shall be advised within thirty (30 days) of the
findings.
11. In the event of a sustained complaint the Chairman of the Ethics Committee
shall forward all necessary documents and testimony to the Board of Directors
for final disposition.
12. Within thirty days the Board of Directors will conduct a final hearing and
will consider any pertinent information offered by the accused person as well as
the complainant.
13. The Board of Directors will determine whether or not there is reasonable
cause to believe that the person(s) involved did in fact commit the act(s) or
omissions. If it is determined the complaint is sustained or partially sustained
the BOD will determine the penalty. The penalty and decision will be deemed
final.
14. For violations of AKC rules or criminal acts pertaining to the care and
welfare of animals no hearings will be conducted. Suspension from CSPCA will be
automatic.
ARBITRATION & LIMITATION OF LIABILITY
If there is any dispute over $500 between any complainant and the CSPCA, both
parties agree to submit it to binding arbitration, using the American
Arbitration Association's (AAA).
Anyone signing the Breeder's Code of Conduct may use that fact, as well as the
CSPCA Code of Conduct logo/seal in their advertising or other information. If
they are found, however, to have violated the Breeder's Code of Conduct – public
notice will be given and they must remove the CSPCA/BCOC logo/seal from all
advertising and other information.
